These Terms and Conditions (“Terms”) govern your access to and use of the jobfinderexpert.com website, mobile applications, and SaaS recruitment platform (collectively, the "Services"). By registering an account or using the Services, you agree to be bound by these Terms.
1. The Platform and User Roles
jobfinderexpert.com provides a SaaS-based venue connecting employers and job seekers. We are not a recruitment agency, headhunter, or employer.
- Employers: Users who subscribe to post job vacancies, search the database, and contact candidates.
- Job Seekers: Users who create profiles and resumes to apply for vacancies.
2. Accounts and Subscriptions
To access the core features of the platform, an active subscription is required.
- Employer Subscriptions: Grants the right to post jobs, view applicant resumes, and use internal chat/calling tools.
- Job Seeker Subscriptions: Profile and resume creation are free. However, a subscription is required to apply for jobs, track application status, and access the chat system.
- Billing: Subscriptions are billed on a recurring basis (monthly or annually). All fees are non-refundable.
- Cancellations: You may cancel your subscription at any time; however, you will retain access until the end of the current billing cycle, and no pro-rated refunds will be issued.
3. Profile Verification ("Verified Status")
We offer an optional Profile Verification service to enhance trust on the platform.
- The Process: Verification may involve identity checks, email/phone validation, or professional credential review.
- Nature of "Verified" Status: A "Verified" badge indicates only that a user has completed our verification process at a specific point in time. It is not a guarantee of the user's skills, character, or the honesty of their resume.
- No Liability: Jobfinderexpert.com is not liable for any damages resulting from a user’s reliance on a "Verified" badge.
- Revocation: We reserve the right to remove verification status if we find the information provided was fraudulent or if the user violates our community standards.
4. Communication System (Chat and Calling)
Our Services include an integrated system for users to message or call one another.
- Professional Conduct: Users must remain professional. Harassment, stalking, or the distribution of unsolicited marketing (spam) is strictly prohibited.
- Monitoring: We reserve the right (but have no obligation) to monitor or review communications for security purposes and to ensure compliance with these Terms.
- Off-Platform Interaction: We are not responsible for any interactions, agreements, or disputes that occur outside of our platform.
5. Data Privacy and Sensitive Information
Because our platform handles resumes and personal identity:
- Job Seekers: You consent to your resume and contact details being shared with Employers when you apply for a position.
- Employers: You agree to handle all applicant data in strict accordance with the UK GDPR and US Privacy Laws (such as CCPA). You must not sell or distribute applicant data to third parties.
- Security: Users should avoid sharing highly sensitive data (e.g., Social Security Numbers or bank details) through the chat system. You do so at your own risk.
6. Prohibited Activities
You agree not to:
- Post fraudulent, "ghost," or misleading job advertisements.
- Use any automated systems (scrapers, bots) to harvest resumes or data from the Site.
- Circumvent the platform's payment or subscription systems.
- Post content that infringes on the intellectual property rights of others.
7. Disclaimers and Limitation of Liability
- "As Is": The Services are provided on an "as is" and "as available" basis.
- No Guarantee: We do not guarantee that Job Seekers will find employment or that Employers will find suitable candidates.
- Vetting: We do not conduct criminal background checks. Users are solely responsible for their own due diligence and vetting.
- Liability Cap: To the maximum extent permitted by law in the UK and USA, Jobfinderexpert.com’s total liability shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless Jobfinderexpert.com, its affiliates, and its employees from any claims, damages, or legal fees arising from your use of the Services, your breach of these Terms, or your violation of any third-party rights.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Kingdom and the United States. You agree that any legal action arising from these Terms shall be brought in the courts of London, UK, or the state in which Jobfinderexpert.com’s US entity is registered.
10. Modifications
We may update these Terms at any time. We will notify users of significant changes by posting a notice on our site or via email. Continued use of the Services after such changes constitutes your acceptance of the new Terms.
